The present legal notice regulates the use of the www.ecrider.es website, which is the property of EC RIDER , registered at the Company Registry of Santa Cruz de Tenerife.
Object and acceptance.
Viewing the page, www.ecrider.es, which is the property of EC RIDER , assigns the position of user of the same and involves the full and unreserved acceptance of each and every one of the provisions of this Legal Notice, which may undergo modifications, which will be applicable independently of the General Conditions of Contracting which may be of obligatory fulfilment, if applicable. Likewise, the user recognises and accepts that access to and use of the website and/or of the contents included thereon takes place freely and consciously, under his exclusive responsibility.
The user undertakes to make correct and licit use of the website and its contents, in accordance with the applicable legislation, the present Conditions of Use of the Website, good faith, generally accepted proper conduct, public order, the uses of ordinary traffic and the present Legal Notice. With the result that the user will be responsible to EC RIDER and third parties for the damage that might be caused as a consequence of the breach of the said obligations.
Conditions of access and use of the website.
EC RIDER may establish additional limitations and/or conditions for use and/or access to the website and/or to its contents, which must be observed by users under all circumstances.
The user recognises and accepts that it is EC RIDER that is the owner of the rights which cover the contents of the website and/or any other elements inserted onto the website (including, without limitation, trade marks, logos, trade names, texts, images, graphics, designs, sounds, data bases, software, flow diagrams, presentation, audio and video), and in consequence they are the property of EC RIDER and/or of third parties who authorise EC RIDER to use them on its website. Under no circumstances will access to the website involve any type of total or partial waiver, transfer, licence or grant of these rights, unless the contrary is expressly stated. The present Conditions of Use of the Website do not grant users any other right of use, alteration, exploitation, reproduction, distribution or public communication of the website and/or of its contents other than those expressly set down herein. Any other use or exploitation of any rights will be subject to the prior and express authorisation specifically granted for this purpose by EC RIDER or the third party that is the owner of the affected rights. For any use other than those expressly permitted, it will be necessary to obtain the prior consent in writing of the owner of the rights in question.
EC RIDER does not guarantee the availability and continuity of operation of the website or of those other web sites with which a link has been established. EC RIDER will likewise not be responsible under any circumstances for any damages which might be derived from such use, including (although not exclusively): errors or omissions in the contents, lack of availability or accessibility of the website, the interruption of the operation of website or computer faults, telephonic breakdowns, disconnections, delays or blockages caused by deficiencies or overloading of the telephone line, on the Internet system or in other electronic systems arising in the course of its operation, the transfer of viruses or programmes which are malicious or damaging in their content although it has adopted all the measures that are technically necessary so as to avoid this.
EC RIDER reserves the right to make, without prior notice, the modifications that it considers to be opportune to its website, and may change, suppress or add both the contents and the services which are provided via the website as well as the manner in which they are presented or located on the website.
The website and its services offer unlimited access free of charge. Nevertheless, EC RIDER makes the use of some of the services conditional on filling out the corresponding form in advance. The user guarantees the authenticity and up-to-date nature of all those data which he supplies to EC RIDER and will be exclusively responsible for false or inexact statements that are made.
EC RIDER reserves the right to deny or withdraw access to its website and/or the services offered without need of prior notice, on its own initiative or that of a third party, from those users who are in breach of the present Conditions of Use.
The User expressly undertakes to make proper use of the contents and services offered and not to use them for:
a) Disseminating contents which are criminal, violent, pornographic, racist, xenophobic, offensive, in defence of terrorism or, in general, against the law or public order.
b) Introducing onto the network computer viruses or carrying out actions that are liable to change, spoil, interrupt or generate errors or damage in electronic documents, data or physical and logical systems of EC RIDER or of third persons; or to cause an impediment to the access of other Users to the website and to its services by means of the massive consumption of the computer resources by means of which EC RIDER provides its services.
c) Attempting to gain access to the e-mail accounts of other users or to restricted areas of the computer systems of EC RIDER or of third parties and, if applicable, extract information.
d) Infringing the rights of intellectual or industrial property or violating the confidentiality of the information of EC RIDER or of third parties.
e) Impersonating another User, the public administration or a third party.
f) Reproducing, copying, distributing, making available or in any other manner publicly communicating, transforming or modifying the Contents, unless it is with the authorisation of the owner of the corresponding rights or the action is legally permitted.
g) Gathering data for advertising purposes and sending advertising of any kind and communications for purposes of sale and others of a commercial nature without any prior request or consent.
Data Protection and Services .
In fulfilment of the provisions of the Organic Act for the Protection of Data of a Personal Nature, LOPD, 15/1999 of 13th December, ELECTRIC CYCLE RIDER TENERIFE SL (hereinafter, EC RIDER ) informs, in an express, precise and unequivocal manner, that the data of a personal nature that the user supplies to us with his consent will be incorporated and dealt with in a file which is the responsibility of EC RIDER which is duly registered with the R.G.P.D. for the correct use of the same.
In the same way and with the purpose of offering a better service, the user is informed that he may be sent information from EC RIDER , its associates and/or collaborators. EC RIDER assures him that the data supplied will be treated in accordance with the LOPD (on security, confidentiality, etc).
The body responsible for the file is EC RIDER , with registered address at Avenida Marqués de Villanueva del prado 1, Edificio Apartamentos Casa Blanca, Local 6, 38400 Puerto de la Cruz, or at any other address, which, if applicable, should replace it and which is registered at the Spanish Data Protection Agency, where the user can apply to make use of his rights of access, rectification, cancellation or opposition.
The user declares that he is informed in accordance with the LOPD (Data Protection Act), that the data supplied are true and complete and that he will keep those data up to date for the conduct of the service. The condition of the data will not be the responsibility of EC RIDER .
The user, by filling in the On Line Reservation Form, accepts and authorises EC RIDER to treat his personal data with the purpose of proceeding to make the requested reservation and to carry out a personalised offer of products and services which will improve the commercial relationship with our customers. Likewise, the user who makes a reservation is informed that his personal and reservation data will be transferred to those companies which have to take part in the management of the reservation and/or travel and to the hotel at the destination, independently of the country in which those companies may be, with the result that there may be international data transfers, with the exclusive aim of managing the reservation and guaranteeing its execution.
EC RIDER may use "cookies" during the provision of services on the website. The cookies are physical files of personal information accommodated in the terminal of the user. The user has the possibility of configuring his browser in such a manner that it prevents the creation of cookie files or warns of their creation.
If the User opts to leave our website via links to websites that do not belong to ourselves, EC RIDER will not be responsible for the privacy policies of those websites nor for the cookies that they may store on the user’s computer.
Our policy with regard to e-mail aims to send only communications that the user has consented to receiving. If he should prefer not to receive these messages via e-mail, we shall offer him via the same the possibility of exercising his right of cancellation and renunciation of the reception of these messages, in accordance with the provisions of Art. 22 of Act 34/2002 on Services for the Information Society and of Electronic Commerce (LSSICE).
Procedure in case of conduct of activities of an illicit nature
If any user or a third party considers that there are facts or circumstances which reveal the illicit nature of the use of any content and/or the conduct of any activity on the web pages included on or accessible from the web site, he must so inform EC RIDER , duly identifying himself, specifying the supposed infringement and declaring expressly and under his responsibility that the information supplied in the notification is exact.
The relationship between EC RIDER and the user will be governed by the Spanish regulations in effect and any dispute will be subject to the Courts of the city of Santa Cruz de Tenerife.
Notifications
All notifications and communications between users and EC RIDER will be considered to be effective, for all purposes, when they are made via ordinary mail, e-mail or telephonic communication. Users must correspond with EC RIDER :
